The attorney for a Butler County woman charged with overdosing while pregnant is asking a judge to dismiss all charges.
According to the Pittsburgh Post-Gazette, the lawyer for 30-year-old Kasey Dischman is arguing that state law bars the Butler County District Attorney’s office from prosecuting Dischman on charges of aggravated assault of an unborn child. The lawyer points to a clause that protects pregnant women from being prosecuted for assaulting their unborn children.
The judge will now review the lawyer’s motion and decide whether to dismiss the charge.
