
A hearing will be held tomorrow in the Butler County Court House on the potential sale of the former Butler Junior High and Middle School.
Attorneys from several interested buyers have filed legal challenges to the sale, claiming the current bid will not be finalized because the zoning ordinance would not be amended by the end of the 120-day contingency plan.
At the last Butler City Council Meeting, the current awardee of the former school, Steve Mitnick, presented his proposal for the building. The City Planning and Zoning Commission needs to receive a request to amend the ordinance from the developer or City Council. This has not happened in time for the April Zoning Commission meeting tomorrow so the earliest that could take place is May.
According to a city official, the process of finalizing an amended zoning ordinance would take about six months. This includes time for the commission to make their recommendation to Council and advertising of the proposed change. If approved, Council would then need to vote twice a month apart before the amended ordinance went into effect.
The hearing is scheduled for 9 a.m. Wednesday morning.
